"Institut Européen d'Hypnose et de Guidance" is a Société par Actions Simplifiée (simplified joint stock company) registered with the Registre du Commerce et des Sociétés of the Tribunal Judiciaire de Strasbourg under number 900 275 314 000 12, having its registered office at 1 domaine de l'Ill, 67400 ILLKIRCH GRAFFENSTADEN, France, and VAT number FR52900275314, represented by Mr Emmanuel BASTIAN.

The "Institut Européen d'Hypnose et de Guidance" offers hypnosis consultations, guidance, energy care and therapeutic accompaniment, in person at the head office (hereinafter referred to as "on site") or by videoconference. Details of services are available on the website www.ie-hg.com (hereinafter referred to as the "Site").

The Site is owned and published by " Institut Européen d'Hypnose et de Guidance ". The publication director is Mr Emmanuel BASTIAN.

  1. General principles

The present General Terms and Conditions for the Provision of Services (hereinafter referred to as the "General Terms and Conditions") define the contractual conditions applicable to the provision of services (hereinafter referred to as the "Provision") concluded between "Institut Européen d'Hypnose et de Guidance" and any Customer.

They are written in French in their original version, which alone is authentic and prevails over any other version.

These General Conditions apply to the exclusion of all other conditions. They are accessible by the Customer on the Site at any time, and are systematically submitted to the Customer before any on-site Service Provision is carried out.

The Customer declares that he is aware of the following provisions before entering into any contract for Services.

Consequently, the conclusion of the contract implies the Customer's full and unreserved acceptance of these General Terms and Conditions.

A printed version of the General Terms and Conditions as well as any information sent by electronic means will be admitted in any legal proceedings concerning the application of these General Terms and Conditions in the same manner and under the same conditions as any other written document kept in paper format.

The fact of not exercising, at any time, a prerogative recognized by the present General Terms and Conditions, or of not requiring the application of any stipulation of the agreement resulting from the said Terms and Conditions, may in no case be interpreted, either as a modification of the contract, or as an express or tacit renunciation of the right to exercise the said prerogative in the future, or of the right to require the scrupulous execution of the commitments entered into herein.

In the event that any of the terms of the General Terms and Conditions are deemed illegal or unenforceable by a court decision, the other provisions shall remain in force.

Modification of the General Terms and Conditions

Taking into account the possible evolutions of the Site, " Institut Européen d'Hypnose et de Guidance " reserves the right to adapt or modify the present General Conditions at any time. Consequently, " Institut Européen d'Hypnose et de Guidance " invites the Customer to consult the General Conditions before any new consultation or training. The General Conditions in force at the time will be applicable to all contracts concluded from the date they are put online.

  1. Legal age and capacity

The Customer declares that he/she is legally capable of entering into this Contract, the General Terms and Conditions of which are set out below, i.e. that he/she has reached the age of majority and is not under guardianship or curatorship.

  1. Services

The essential characteristics of the Services are described for each Service on the Site. They have been presented to the Customer prior to the conclusion of the contract, as part of the pre-contractual information provided.

The "Institut Européen d'Hypnose et de Guidance" offers :

  • Psychogenealogy consultation
  • Tarology consultation
  • Kibomancy consultation
  • Hypnosis consultation (communication with the deceased, spiritual hypnosis for regression, therapeutic hypnosis and cognitive behavioral therapy)
  • Energy treatments (Esseiniens and REIKI)
  • Hypnosis training
  1. Contract conclusion

The contract is concluded by signing the General Conditions.

The conclusion of a contract implies acceptance of the description of the Services and the prices in force on the day the contract is concluded.

  1. Price

Service prices

Service prices are quoted in euros, inclusive of all taxes. They take into account the VAT in force in France on the day the contract is concluded.

Cost of using remote communication technology

Access to the Site is via the Internet.

The cost of access to the Internet using a remote communication service is borne by the Customer.

  1. Payment

Payment for the Service is to be made in cash on the day the contract is concluded. For the purposes of the present article, payment is deemed to have been made when the funds are actually made available to the "Institut Européen d'Hypnose et de Guidance".

Terms of payment

Invoices are payable in euros to the head office of "Institut Européen d'Hypnose et de Guidance".

Payment can be made by cash, cheque or online via a computerized payment system.

For on-site services, payment is authorized by check, cash or via the online payment terminal. Cheques should be made payable to"Institut Européen d'Hypnose et de Guidance".

For videoconferencing services, payment is made exclusively via the online payment terminal by credit card (Visa, MasterCard), PayPal or Stripe under the following conditions.

Transaction security

In order to optimize the security of Internet transactions, the Site uses an SSL (Secure Socket Layer) online payment system, so that every effort is made to ensure the confidentiality and security of data transmitted during online payments.

Our online payment systems Paypal or Stripe automatically check the validity of access rights when paying by credit card, and encrypt all exchanges to guarantee confidentiality.

To benefit from the SSL secure payment mode, the Customer must use SSL-compatible browsers.

  1. Contract performance

Make an appointment

Appointments can be made by telephone, e-mail, using the form on the Site or via the Calendly website.

Place of performance

Services are provided at the Company's head office or by videoconference.

Rescheduling appointments

The customer may change the appointment date no later than 48 hours before the scheduled date, free of charge and without compensation.

Appointment cancellations

In the event of cancellation of the appointment at the initiative of "Institut Européen d'Hypnose et de Guidance", the Customer will be reimbursed for all sums paid, if applicable, or may be offered a replacement appointment.

In the event of cancellation of the appointment by the Customer less than 48 hours before the date of the appointment and except in cases of force majeure, the full price of the Service will remain due to "Institut Européen d'Hypnose et de Guidance" as compensation.

  1. Liability

Information

The "Institut Européen d'Hypnose et de Guidance" makes every effort to ensure that the information published on the Site is accurate and up-to-date, and reserves the right to modify it at any time and without prior notice. However, it cannot guarantee the accuracy, precision or completeness of the information on the Site. Consequently, it declines all responsibility for any imprecision, inaccuracy or omission in the information available, as well as all responsibility for damage resulting from fraudulent intrusion by a third party leading to modification of the information contained on the Site.

Service Compliance

The "Institut Européen d'Hypnose et de Guidance" undertakes to provide the requested Service in accordance with the contractual forecasts and the rules of the art. To this end, it will provide the necessary human and material resources.

Use of the Site

The use of and browsing on the Site are under the responsibility of the Customer. "Institut Européen d'Hypnose et de Guidance" declines all responsibility and cannot be held responsible for any damage or virus that may affect computer equipment or any other material when accessing the Site, using the Site or browsing the Site, downloading any content, data, text, images or files from the Site.

Non-compliant use/installation of the Prestation

"Institut Européen d'Hypnose et de Guidance" is responsible for the non-conformity of the Service under the conditions of common law.

  1. No right of withdrawal

In application of article L. 221-18 of the French Consumer Code, the Customer expressly waives his right of withdrawal for Services concluded via the Site, insofar as they are fully executed within 14 days of the conclusion of the contract.

  1. Intellectual property

The Customer has no intellectual property rights on the Services, "Institut Européen d'Hypnose et de Guidance" remaining the exclusive owner of all these rights.

Any use whatsoever by the Customer of the trademark "Institut Européen d'Hypnose et de Guidance" or of any other trademark belonging to "Institut Européen d'Hypnose et de Guidance" is strictly forbidden, except with the express agreement of "Institut Européen d'Hypnose et de Guidance".

The content and structure of the Site are protected by copyright and intellectual property laws worldwide.

As such, and in accordance with the provisions of the French Intellectual Property Code, only private use is authorized, subject to different or even more restrictive provisions of the French Intellectual Property Code.

  1. Personal data protection

"Institut Européen d'Hypnose et de Guidance" declares that it complies with and undertakes to comply with the personal data regulations in force in France, and in particular the European Data Protection Regulation of April 27, 2016 (RGPD) and the French Data Protection Act of January 6, 1978 as amended.

13.1. Collected data

In order to carry out the Services, "Institut Européen d'Hypnose et de Guidance" collects personal data for the purposes of concluding the Contract, carrying it out, managing it and drawing up invoices. " Institut Européen d'Hypnose et de Guidance" may use your personal data for commercial solicitations in accordance with current legal requirements. The data collected in this context is as follows: first name, surname, e-mail address and telephone number. Collection is based on the performance of the Contract.

At the time of collection, certain data must be provided and are indicated by an asterisk, while others are optional.

The "Institut Européen d'Hypnose et de Guidance" undertakes not to use the data collected for purposes other than those mentioned above (unless required by a competent judicial and/or administrative authority).

Your data is kept in an active database for the duration of the Contract or 3 years from the last contact with you, and in an archive database for 5 years, the duration of the statute of limitations under common law.

The recipient of the data is "Institut Européen d'Hypnose et de Guidance"." Institut Européen d'Hypnose et de Guidance" however reserves the right to transmit all or part of its customers' personal data to its subcontractors for the purposes of the Contract, and in particular for the performance of any contract.

The "Institut Européen d'Hypnose et de Guidance" undertakes to take all necessary precautions to protect the security of the data communicated and, in particular, to prevent it from being distorted, damaged or accessed by unauthorized third parties.

You have the right to ask "Institut Européen d'Hypnose et de Guidance" to access, rectify, delete or port your personal data. You also have the right to request the restriction of processing or to object to the processing of your personal data. You have the right to withdraw your consent to the processing of your data at any time.

  1. Force majeure

The "Institut Européen d'Hypnose et de Guidance" is not liable for any breach of its contractual obligations in the event of force majeure or fortuitous events, including, but not limited to, catastrophes, fires, internal or external strikes, internal or external failures or breakdowns, and in general any event preventing the proper performance of the contract.

  1. Applicable law and jurisdiction

These General Terms and Conditions are governed by French domestic law, to the exclusion of any international convention.

In the event of any dispute relating to these General Terms and Conditions or to the performance of the Services, the parties will endeavour to resolve their dispute amicably.

Failing amicable agreement, the competent court is that of the place of performance of the Service, i.e. the registered office of "Institut Européen d'Hypnose et de Guidance" , even if the Service is performed by telephone or videoconference.

  1. Recourse to the consumer ombudsman

If you are a "consumer" as defined in the preliminary article of the French Consumer Code, you must first send us your complaint.

If this attempt fails, you may have recourse to a conventional mediation procedure or any other alternative dispute resolution method, in particular by having recourse, free of charge, within one year of your complaint, to the competent consumer mediator in accordance with the provisions of Title 5 of Book I of the Consumer Code:
